On page 5, after line 37, insert the following:

"(12) If the recipient of any civil investigative demand issued under this section does not respond to a demand and provides a good faith justification citing a lack of understanding of the demand or cannot afford an attorney to assist in responding to the demand, any court of competent jurisdiction may appoint an attorney at the state's expense."

EFFECT: Provides process for appointment of an attorney if the recipient of a CID fails to comply with a demand and the lack of compliance is based on a good faith justification related to an inability to understand the demand or afford an attorney.
