On page 1, after line 12, insert the following:
"(b) The attorney general may not issue written civil investigative demands under this section based on information obtained by an investigator employed by the office of the attorney general for undercover or covert civil or criminal law enforcement activities if such investigator used a confidential driver's license or identicard issued pursuant to RCW 46.08.--- (section 1, chapter . . . (Senate Bill No. 5829 or House Bill No. 2906), Laws of 2026) during the course of an investigation."
On page 5, after line 37, insert the following:
"(12)(a) All investigators employed by the office of the attorney general conducting an investigation pursuant to this section must be conspicuously identifiable in the course of their duties.
(b) For purposes of this subsection, "conspicuously identifiable" means that the investigator's outfit clearly displays the name or other information that members of the public can see and that the office of the attorney general can use to identify the investigator."
EFFECT: Prevents the attorney general from issuing written civil investigative demands based on information obtained by an investigator employed by the office of the attorney general who used a confidential driver's license or identicard during the course of an investigation. Requires such investigators to be conspicuously identifiable in the course of their duties.
