Brief Description: Concerning the notice of sale or lease of manufactured/mobile home communities.

Brief Summary of Substitute Bill
  • Modifies requirements for an owner to provide a written notice of opportunity to compete to purchase (notice) if the owner intends to sell a manufactured/mobile home community or intends to consider a purchase offer received.
  • Requires an owner to provide the Department of Commerce with an update on the status of the sale every six months from delivery of the notice.
  • Removes the requirement for an owner to provide a written notice of sale to tenants and certain entities.

Background:

Notice of Sale.

An owner must provide a written notice of sale of a manufactured/mobile home community (MHC) to:

  • each tenant of the MHC;
  • the officers of any known qualified tenant organization (QTO);
  • the Office of Mobile/Manufactured Home Relocation Assistance at the Department of Commerce (Commerce);
  • the city or county where the MHC is located;
  • any housing authority where the MHC is located; and
  • the Washington State Housing Finance Commission (WSHFC).

 

The notice of sale must include a statement that the owner intends to sell or lease the MHC or the property and the contact information of the owner or owner's agent regarding the sale of the property.

 

Notice of Opportunity to Compete to Purchase.

An owner must provide a written notice of an opportunity to compete to purchase (notice) indicating the owner's interest in selling the MHC before the owner markets the MHC for sale.  A landlord must also provide a notice when the owner receives a purchase offer that the owner intends to consider, unless that offer is received during the process of a QTO purchasing the community.

 

The notice must be provided by certified mail or personal delivery to:

  • all tenants of the manufactured/mobile home community;
  • a QTO, if one exists;
  • Commerce; and
  • the WSHFC.

 

The notice must include the following:

  • the date the notice was mailed or personally delivered to all recipients;
  • a statement that the owner intends to sell the MHC or the underlying property;
  • a statement that the tenants, through a QTO or other eligible organization, have an opportunity to compete to purchase the MHC;
  • a statement that in order to compete to purchase the MHC, the tenants must form or identify a single QTO for the purpose of purchasing the MHC and notify the owner in writing within 70 days after delivery of the notice; and
  • a statement that information about purchasing an MHC is available from Commerce.
Summary of Bill:

Notice of Sale.

The requirement that an owner provide a written notice of sale of an MHC to tenants and other entities is eliminated.

 

Notice of Opportunity to Compete to Purchase.

The city or county and any housing authority where the MHC is located is added to the entities to which a landlord must provide the written notice.

 

The notice to tenants must be served by personal service, or if the tenant is absent from the manufactured/mobile home, by affixing a copy of the notice in a conspicuous place on the home and also mailing a copy.  Notice to parties other than the tenants and the officers of a QTO may be delivered electronically.

 

The notice sent to Commerce must include:

  • a complete list of all current tenants and contact information listed on the leases within the MHC in an electronic format or on a form as provided by Commerce; and
  • one copy of the notice as sent to each tenant.

 

Every six months from delivery of the notice, until the property is sold or taken off the market, the owner must provide Commerce with an update on the status of the notification and the MHC's sale. The update must include:

  • the date the notice was sent by mail, electronically delivered, or personally delivered to all required recipients;
  • the status of the sale or the opportunity to compete to purchase as active, under contract, closed, or removed from the market;
  • if the property has sold, the date of closing;
  • if the property is under contract, the anticipated closing date; and
  • if the property is active, any change in listing price and other information.

 

An owner must provide the notice if the tenants are competing to purchase the park and the landlord receives another purchase offer that the landlord intends to consider.
