AN ACT Relating to unfair practices in insurance; and adding a new section to chapter 48.30 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 48.30 RCW to read as follows:

          (1) It is an unfair and deceptive practice for any insurer to fail to act in good faith to effectuate the fair, equitable and prompt settlement of a claim in which liability has become reasonably clear.

          (2) A violation of this section or any rules adopted under it shall constitute a violation of RCW 19.86.020.
