AN ACT Relating to the operation of a motor vehicle by a person with a positive blood alcohol level; adding a new section to chapter 46.61 RCW; and prescribing penalties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 46.61 RCW to read as follows:

          (1) Any person with a positive blood alcohol level as shown by chemical analysis of the blood, breath, or other bodily substance who drives a motor vehicle shall be subject to a civil fine in the amount of ten dollars for each one-thousandth of one percent of the blood alcohol level above five one-hundredths of one percent.

          (2) The penalty in this section is in addition to any other penalty that may be provided by law.
