BACKGROUND:

 

The present law specifies what constitutes an apartment in relation to condominiums.  Within the definition of apartment, places that are separately delineated for the storage or moorage of a boat or plane are considered apartments.

 

The present law does not specifically authorize the development of storage facilities for motor vehicles as apartments.

 

As a result of this omission, some title insurance companies have been unwilling to issue a title insurance policy on condominium type parking facilities.

 

SUMMARY:

 

The state law on condominium development is amended to include storage facilities for motor vehicles in the definition of apartment.

House Committee - Testimony For:    The need for new financing techniques for parking facilities is needed.  The development of storage facilities through a condominium approach is already in use for boats and airplanes.  By adding motor vehicles to the list, we allow parking facilities to be developed using the condominium concept.  This bill provides opportunities for cities to develop needed parking facilities.
