BACKGROUND:

 

By statute, city and county disability boards have been established to approve or disapprove the disability claims of law enforcement officers and fire fighters.  Similar boards have been created for city police and fire fighter pensions.  Included among the members of the board are law enforcement officers and fire fighters.  The statute does not specify whether retired officers or fire fighters may vote for board members or serve on the board.

 

SUMMARY:

 

Retired law enforcement officers and fire fighters who are subject to the jurisdiction of a city or county disability board or a pension board have the right to elect members to the respective board and to be elected to the board.
