BACKGROUND:
Prior to 1986, the insurance commissioner served as state fire marshal. One of the duties of the fire marshal was to issue licenses relating to fireworks. In 1986, the legislature transferred the fireworks functions to the director of Community Development, acting through a new director of Fire Protection.
Although the Department of Community Development now issues fireworks licenses, the appeal provision continues to provide that a person denied a license is entitled to a hearing under the insurance appeal provisions.
SUMMARY:
The appeal procedure for a person denied a fireworks license is changed from the insurance appeal provisions to the administrative procedure act.
