AS PASSED SENATE, MARCH 9, 1987
BACKGROUND:
The Legislature created a "Housing Authority" in every city, town and county. Before the Authority can transact any business or exercise its powers, the legislative authority of the city, town, or county must pass a resolution declaring the need for an Authority to function.
Some housing authorities, formerly activated, are no longer functioning or necessary (e.g., North Bonneville). No statutory authority and procedure exists for the deactivation or abolishment of a Housing Authority.
SUMMARY:
A Housing Authority may be deactivated or abolished by resolution or ordinance by the legislative authority of the city, town, or county. The legislative authority is permitted to exercise power to wind up the affairs of the Housing Authority.
Fiscal Note: none requested
Senate Committee - Testified: No one
HOUSE AMENDMENT:
The House striking amendment: (1) specifies the procedures used to abolish or deactivate a housing authority, including the consideration of certain findings; and (2) specifies the distribution of assets of a deactivated housing authority.
