AN ACT Relating to mandatory utility services; adding a new section to chapter 35.63 RCW; and adding a new section to chapter 35A.63 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 35.63 RCW to read as follows:

          Where city water and sewer is available for hook-up to a parcel of property within county boundaries, the city planning agency may not require the property owner to abide by city zoning or permit conditions, if different from county requirements, as a prerequisite to allowing hook-up to those services.

          The city shall provide the water and sewer service if:  (1) The services are the most appropriate source from which to obtain such utilities; and (2) the property owner pays the same fees as required of property owners within the city limits.
