AN ACT Relating to pharmacy services; and adding a new section to chapter 74.09 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 74.09 RCW to read as follows:

          (1) Reimbursement to pharmaceutical providers for covered pharmaceutical services shall be made on the basis of product acquisition cost plus a professional fee.

          (2) The fee shall be limited to the lesser of:

          (a) Ninety percent of the product acquisition cost plus the professional fee, as determined by a survey conducted by the department of social and health services; or

          (b) Usual and customary fee charges of each individual pharmacy as determined by a prescription survey addendum to the pharmacy cost report.
