AN ACT Relating to controlled substances; adding a new section to chapter 69.50 RCW; and prescribing penalties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 69.50 RCW to read as follows:
(1) Every person convicted of a violation of RCW 69.50.410 shall be fined two thousand dollars in addition to any other fine or penalty imposed.
(2) The fine constitutes a judgment against the person and the person's property, both real and personal, and may be enforced as any other judgment under chapter 6.04 RCW. The prosecuting attorney of the county where the person was convicted may bring an action to enforce the judgment.
(3) Any money collected under this section shall be disbursed in the following manner:
(a) One-half of the amount collected shall be deposited in the drug fund of the county in which the person was convicted of a violation of RCW 69.50.410 to provide rewards to informants under chapter 10.85 RCW;
(b) One-quarter of the amount collected shall be deposited in the county or interlocal drug fund for the use of the arresting law enforcement agency; and
(c) One-quarter of the amount collected shall be deposited with the state general fund for the use of the judicial information system.
RCW 3.62.090, 10.82.070, and 43.08.250 do not apply to any money collected under this section.
