AN ACT Relating to local improvement districts; and adding a new section to chapter 36.94 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 36.94 RCW to read as follows:

          (1) A county or county health district shall not require a property owner, as a condition to the granting of any permit, to agree, by covenant or otherwise, to:

          (a) Join in any petition for the formation of a local improvement district or utility local improvement district; or

          (b) Decline to protest the formation of a local improvement district or utility local improvement district.

          (2) Any agreement or covenant that violates subsection (1) of this section, including an agreement or covenant entered into prior to the effective date of this section, is contrary to public policy and is void.
