AN ACT Relating to operation or physical control of a motor vehicle in conjunction with alcohol; adding a new section to chapter 46.61 RCW; and prescribing penalties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 46.61 RCW to read as follows:

          (1) A person with 0.05 grams or more of alcohol per two hundred ten liters of breath, as shown by chemical analysis of the blood, breath, or other bodily substance made under RCW 46.61.506, who operates or has actual physical control of a motor vehicle within this state is subject to a civil fine in the amount of fifty dollars for each one-hundredth gram above 0.05 grams of alcohol per two hundred ten liters of breath.

          (2) The penalty in this section is in addition to any other penalty that may be provided by law.
