AN ACT Relating to mammograms; adding a new section to chapter 48.20 RCW; adding a new section to chapter 48.21 RCW; adding a new section to chapter 48.44 RCW; and adding a new section to chapter 48.46 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 48.20 RCW to read as follows:

          Each disability insurance contract issued or renewed after July 1, 1988, that insures for hospital or medical care shall provide coverage for the following for screening or diagnostic purposes upon the referral of the patient's physician:

          (1) A baseline mammogram for women age thirty-five to thirty-nine, inclusive;

          (2) A mammogram for women age forty to forty-nine, inclusive, every two years or more frequently based on the woman's physician's recommendation;

          (3) A mammogram every year for women age fifty and over.

          This section shall not be construed to prevent the application of deductible or copayment provisions contained in the policy.

          Each group disability insurance contract issued or renewed after July 1, 1988, that insures for hospital or medical care shall provide coverage for the following for screening or diagnostic purposes upon the referral of the patient's physician:

          (1) A baseline mammogram for women age thirty-five to thirty-nine, inclusive;

          (2) A mammogram for women age forty to forty-nine, inclusive, every two years or more frequently based on the woman's physician's recommendation;

          (3) A mammogram every year for women age fifty and over.

          This section shall not be construed to prevent the application of deductible or copayment provisions contained in the policy.

          Each health care service contract issued or renewed after July 1, 1988, that insures for hospital or medical care shall provide coverage for the following for screening or diagnostic purposes upon the referral of the patient's physician:

          (1) A baseline mammogram for women age thirty-five to thirty-nine, inclusive;

          (2) A mammogram for women age forty to forty-nine, inclusive, every two years or more frequently based on the woman's physician's recommendation;

          (3) A mammogram every year for women age fifty and over.

          This section shall not be construed to prevent the application of deductible or copayment provisions contained in the policy.

NEW SECTION. Sec. 4.  A new section is added to chapter 48.46 RCW to read as follows:

          Each health maintenance agreement issued or renewed after July 1, 1988, that insures for hospital or medical care shall provide coverage for the following for screening or diagnostic purposes upon the referral of the patient's physician:

          (1) A baseline mammogram for women age thirty-five to thirty-nine, inclusive;

          (2) A mammogram for women age forty to forty-nine, inclusive, every two years or more frequently based on the woman's physician's recommendation;

          (3) A mammogram every year for women age fifty and over.

          This section shall not be construed to prevent the application of deductible or copayment provisions contained in the agreement.
