AN ACT Relating to installation of underground facilities; adding new sections to chapter 47.44 RCW; adding a new section to chapter 35.21 RCW; adding a new section to chapter 35A.21 RCW; and adding a new section to chapter 36.32 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 47.44 RCW to read as follows:

          Standards for the installation of underground facilities using fiber optic transmission lines under franchises and other agreements with the state, counties, cities, and towns shall be adopted by the secretary of transportation by rule by January 1, 1989.  To develop these standards, the secretary shall appoint an advisory committee consisting of representatives of counties, county road administration boards, cities, the department of transportation, and the utilities and transportation commission.

NEW SECTION. Sec. 2.  A new section is added to chapter 47.44 RCW to read as follows:

          Any underground facilities using fiber optic transmission lines installed under a utility franchise granted by the state or by agreement with the state under this title shall be installed in accordance with standards developed under section 1 of this act.

NEW SECTION. Sec. 3.  A new section is added to chapter 35.21 RCW to read as follows:

          Any underground facilities using fiber optic transmission lines installed under a utility franchise granted by a city or town or by agreement with a city or town under this title shall be installed in accordance with standards developed under section 1 of this act.

NEW SECTION. Sec. 4.  A new section is added to chapter 35A.21 RCW to read as follows:

          Any underground facilities using fiber optic transmission lines installed under a utility franchise granted by a city or by agreement with a city under this title shall be installed in accordance with standards developed under section 1 of this act.

NEW SECTION. Sec. 5.  A new section is added to chapter 36.32 RCW to read as follows:

          Any underground facilities using fiber optic transmission lines installed under a utility franchise granted by a county or by agreement with a county under this title shall be installed in accordance with standards developed under section 1 of this act.
