                                   SENATE CONCURRENT RESOLUTION NO. 8409

WHEREAS, Washington's Juvenile Justice Act envisions the joint action of the Legislature and the Juvenile Disposition Standards Commission in determining disposition standards to be used in sentencing convicted juvenile offenders; and

          WHEREAS, It is the responsibility of the Juvenile Dispositions Standards Commission under RCW 13.40.030 to submit to the Legislature by November 1 of each even-numbered year proposed disposition standards for all offenses; and

          WHEREAS, It is the responsibility of the Legislature under RCW 15.40.030 to review the Commission's proposed standards and adopt them or refer them to the Commission for modification, as the Legislature deems appropriate; and

          WHEREAS, The Commission's recommendations have been presented to the appropriate standing committee of the Senate; and

          WHEREAS, That standing committee referred the proposed standards back to the Commission for modification to provide an increase in the classification for violations of the Uniform Controlled Substances Act; and

          WHEREAS, The Commission has met to reconsider the standards and the specific suggested legislative recommendations for changes but remains divided on the question and, thus, makes no additional modifications; and

          WHEREAS, The Commission has resubmitted the proposed standards to the Legislature in a timely fashion; and

          WHEREAS, The Legislature, pursuant to RCW 13.40.030(4), is authorized to modify the resubmitted proposed standards;

          NOW, THEREFORE, BE IT RESOLVED, By the Senate of the State of Washington, the House of Representatives concurring, That the Legislature, in accordance with the provisions of RCW 13.40.030(4), modify the dispositions standards resubmitted by the Juvenile Dispositions Standards Commission as follows and adopt such standards as reflected below and in the attached Schedule A.

          (1) The Juvenile Disposition Offense Category for a violation of the Uniform Controlled Substances Act--Narcotic (RCW 69.50.401) is increased from a B Classification to a B+ Classification.

(2) The Juvenile Disposition Category for attempt, bail jump, conspiracy, or solicitation for a violation of the Uniform Controlled Substances Act--Narcotic (RCW 69.50.401) is increased from its current B Classification to a B+ Classification.

(3) The Juvenile Disposition Offense Category for a violation of the Uniform Controlled Substances Act--Nonnarcotic (RCW 69.50.401) is increased from a C Classification to a C+ Classification.

(4) The Juvenile Disposition Category for attempt, bail jump, conspiracy, or solicitation for a violation of the Uniform Controlled Substances Act--Nonnarcotic (RCW 69.50.401) is increased from a C Classification to a C+ Classification.

(5) The Juvenile Disposition Offense Category for the sale of controlled substances for profit (RCW 69.50.410) is increased from a C Classification to a B Classification.

(6) The Juvenile Disposition Category for attempt, bail jump, conspiracy or solicitation for sale of controlled substances for profit (RCW 69.50.410) is increased from a C Classification to a B Classification.
