JURISDICTION DETERMINATION - ORDER OF DISMISSAL

I. Nature of the Complaint

The complainant makes various allegations against Chase Riveland, Secretary of the Department of Corrections; Robert Wright, Superintendent of the Clallam Bay Correctional Center; Lt. J. Ary, Disciplinary Hearings Officer, Clallam Bay Correctional Center; and David Trieweiler, Contract Attorney for the Department of Corrections.

II. Jurisdictional Determination

RCW 42.52.320 limits the jurisdiction of the Legislative Ethics Board to alleged violations of the chapter, and related rules, by "members and employees of the legislature." RCW 42.52.360 establishes ethics jurisdiction in the Executive Ethics Board over state officers and employees of the executive branch.

None of the named respondents in this complaint are officers or employees in the legislative branch of state government.

III. Conclusion and Order

The board lacks jurisdiction over the respondents. The complaint is dismissed.
