Must prospective and current employees, volunteers, interns, and subcontractors be disqualified from having access to the children in my facility?

(1) The department must disqualify prospective and current employees, volunteers, interns, and subcontractors if they do not meet the regulations of chapter 388-145 WAC, or cannot have unsupervised access to children because of their background check as outlined in chapter 388-06A WAC.
(2) The department must disqualify prospective and current employees, interns, volunteers, and subcontractors if they have had a negative action taken on a license or contract, or have had a license denied or revoked by an agency that regulates the care of children or vulnerable adults, unless the department determines that the individual does not pose a risk to a child's safety, well-being, and long-term stability.
(3) Applicant's, employees, interns, volunteers, and subcontractors must demonstrate that they have the understanding, ability, physical health, emotional stability, and personality suited to meet the physical, mental, emotional, cultural, and social needs of the children under their care.
(4) The department will notify the licensee if a prospective or current employee, intern, volunteer, or subcontractor is disqualified from having unsupervised access to children. Hiring a person disqualified by DSHS or continuing to allow unsupervised access to children by a person disqualified by DSHS could also lead to denial, suspension, or revocation of your license issued under this chapter.
