(1) Department of health authority. The department has authority to enter any building or area used for TWH, at reasonable times to:
(a) Inspect the site for compliance with this chapter and related standards; and
(b) Determine, based on reasonable cause, if a building or condition on the premises is unsafe, dangerous or hazardous.
(2) Refusal of entry. When the operator refuses entry or has required a warrant, the department of health will seek remedies provided by law to secure entry to the TWH site.
(3) Occupied TWH. The department of health must present credentials to the occupant and request the right to enter a dwelling unit when occupants are in residence.
(4) Unoccupied TWH. When a dwelling unit does not have occupants in residence, the department of health must make a reasonable effort to locate the operator of the TWH to request entry.
