RCW 34.05.328 does not apply to this rule adoption.

WAC 180-27-032
Growth impact fees and mitigation payments.
Notwithstanding the financial requirements of WAC 180-27-030,
districts may use growth impact fees as provided for in RCW 82.02.020, 82.02.050 through 82.02.100, 58.17.060 and 58.17.110
to assist in capital construction projects. The impact fees
collected pursuant to the above cited statutes, may be used by
the district as local match funding for state assisted capital
projects and may not be substituted for the amount of state
assistance that would otherwise be provided for school capital
projects. Mitigation payments as provided for in RCW 43.21C.060
of the State Environmental Policy Act may ((not)) be used by the
district as local match funding ((nor)) and may not be
substituted for the amount of state assistance that would
otherwise be provided for school capital projects.
