FISH AND WILDLIFE

Purpose: Amend fishing rules.
Citation of Existing Rules Affected by this Order: Repealing WAC 232-28-61900X; and amending WAC 232-28-619.
Statutory Authority for Adoption: RCW 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: Washington department of fish and wildlife predicts that 1,100 hatchery (adipose fin-clipped) spring chinook will return to the Ringold Springs Rearing Facility (RSRF) in 2008. These salmon were reared with funding from the Confederated Tribes of the Umatilla Indian Reservation (CTUIR). All of the fish were adipose fin-clipped prior to release. This is the second consecutive year for the Ringold Area Bank Fishery for spring chinook. This fishery will be intensively monitored with the objective of providing a 50:50 allocation between angler harvest and trapped adults for the CTUIR's Walla Walla reintroduction program. The fishery may be closed with little advance notice to allow sufficient numbers of fish to be trapped for the CTUIR. There is insufficient time to promulgate permanent rules.
