WSR 13-23-004 PREPROPOSAL STATEMENT OF INQUIRY DEPARTMENT OF TRANSPORTATION [Filed November 7, 2013, 7:18 a.m.]
Subject of Possible Rule Making: Engineering and traffic investigation of request for transit vehicle stop zone. This proposal would be a revision to the current WAC 468-46-010, 468-46-020 and to rescind 468-46-060 to remove rules that require the development of improvements that eliminate temporary stops by transit vehicle[s] in the roadway for the purpose of receiving or discharging passengers.
Statutes Authorizing the Agency to Adopt Rules on this Subject: 1977 ex.s. c 151. WSR 79-01-033 (DOT Order 10 and Comm. Order 1, Resolution No. 13), § 468-46-010, 468-46-020, 468-46-060[,] filed 12/20/78. Formerly WAC 252-34-01001, 252-34-02001, and 252-34-060.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The Washington state department of transportation (WSDOT) seeks more flexibility in the determination of need for a bus pullout in response to a request for a bus stop and provide consistent language in rules that determine when and where a transit vehicle may stop temporarily in a roadway for the purpose of receiving or discharging passengers.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None identified.
Process for Developing New Rule: The revision is proposed in response to WSDOT executive and management direction to improve flexibility in the development and design of bus stop locations on state highways.
Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication by contacting Geri Beardsley, Washington State Transit Association, (360) 786-9734 ext. 325, geri@watransit.com. Geri coordinate[s] a monthly conference call with transit agencies statewide.
