PREPROPOSAL STATEMENT OF INQUIRY

     Subject of Possible Rule Making: Working connections child care, WAC 388-290-0273 When would my provider be assessed an overpayment?, and other sections as appropriate.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 74.04.050, 74.12.340, 74.13.085.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: By changing this rule, DSHS would allow WCCC payment and not be required to assess an overpayment to a child care provider if they have sufficient documentation in their attendance records showing the child was in their care.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: None.

     Process for Developing New Rule: All interested parties are invited to review and provide input on the draft language. Obtain draft material by contacting the individual below. At a later date, a draft of this rule will also be posted on the policy proposal comment internet site at http://www1.dshs.wa.gov/esa/extpolicy/ before the formal rule proposal.
