EMERGENCY RULES
Effective Date of Rule: Immediately.
Purpose: WAC 308-108-025A, informs interested persons of the fees charged by the department of licensing for driver training school and instructor's licenses.
Statutory Authority for Adoption: RCW 46.82.290, 46.82.310, 46.82.320, and 46.82.340.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: Chapter 219, Laws of 2006 (HB 2829), transfers the authority to set fees for driver training school and instructor's licenses from statute to rule of the department of licensing. Since chapter 219, Laws of 2006, includes an emergency clause, and is effective immediately upon signing by the governor, it is necessary to immediately adopt a rule setting the fees for these licenses in order to preserve the public safety by permitting the continued licensing of driver training schools and instructors pending the adoption of a permanent rule.
