PREPROPOSAL STATEMENT OF INQUIRY

DEPARTMENT OF COMMUNITY,

TRADE AND ECONOMIC DEVELOPMENT

     Subject of Possible Rule Making: Chapter 365-230 WAC, Lead-based paint.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: Chapter 70.103 RCW.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Revisions are needed in order to accomplish two main objectives: (1) Improve efficiency of program administration; and (2) align state regulations with federal standards.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: The United States Environmental Protection Agency (EPA) is the designated agency for lead-based paint regulations at the federal level. CTED will coordinate EPA throughout the rule-revision process.

     Process for Developing New Rule: Lead-based paint task force.
