PREPROPOSAL STATEMENT OF INQUIRY

     Subject of Possible Rule Making: WAC 388-502-0240 Audits and the audit appeal process for contractors/providers.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 74.08.090 and 74.09.200.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Revisions of these rules are necessary to update and clarify the current audit review and appeal process including, but not limited to, deleting redundant sections and outdated sections. The department is also moving this section into new chapter 388-502A WAC.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: DSHS - office of financial recovery (OFR), department of health (DOH). The health and recovery services administration will include staff from OFR and DOH during the drafting and review of these rules.

     Process for Developing New Rule: The department invites the interested public to review and provide input on the draft language of this rule. Draft material and information about how to participate may be obtained from the department representative listed below.
