     Title of Rule and Other Identifying Information: Repealing chapter 118-02 WAC, Public records.

NOTICE

     THIS RULE IS BEING PROPOSED UNDER AN EXPEDITED RULE-MAKING PROCESS THAT WILL ELIMINATE THE NEED FOR THE AGENCY TO HOLD PUBLIC HEARINGS, PREPARE A SMALL BUSINESS ECONOMIC IMPACT STATEMENT, OR PROVIDE RESPONSES TO THE CRITERIA FOR A SIGNIFICANT LEGISLATIVE RULE. IF YOU OBJECT TO THIS USE OF THE EXPEDITED RULE-MAKING PROCESS, YOU MUST EXPRESS YOUR OBJECTIONS IN WRITING AND THEY MUST BE SENT TO Jill Bushnell, Military Department, Building 1, Camp Murray, Washington 98430-0001 , AND RECEIVED BY January 2, 2007.


     Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: This proposal repeals a duplicative rule for public records. The military department, emergency management division, is covered by the military department rule for public records, chapter 323-10 WAC. The repeal of chapter 118-02 WAC would have no effect.

     Reasons Supporting Proposal: This rule is unnecessary because it applies to a division within the military department, and a department-level rule on the same topic exists.

     Statutory Authority for Adoption: RCW 34.05.353.

     Statute Being Implemented: RCW 42.56.040.

     Rule is not necessitated by federal law, federal or state court decision.
