INTERPRETIVE AND POLICY STATEMENT

     In accordance with RCW 34.05.230(12), enclosed are the policy and interpretive statements issued by the department regarding the insurance services division policies in August 2007.

Insurance Services, State Fund Claims Administration, Self Insurance, and Crime Victims

     Interim Policy 5.12 Paying Time-Loss Compensation When Employer Also Pays Worker.

     This policy applies to state fund, self-insured and crime victims workers' compensation claims. This policy was updated to be consistent with recently passed legislation (SSB 5676). Holiday pay, vacation pay, sick leave, paid-time-off or other similar benefits are not considered payment of full wages by the employer. These benefits do not meet the definition of kept on salary.

     Provider Bulletin 07-06 Brevio¦ Nerve Conduction Testing System.

     This provider bulletin became effective August 1, 2007. This bulletin applies to state fund, self-insurance and crime victims compensation.

     Brevio¦ nerve conduction testing system is not covered due to the lack of published literature showing the diagnostic accuracy for the intended use. It is considered investigational and experimental. L&I determined there is not scientific evidence directly addressing the safety, technical capacity, diagnostic accuracy or utility of the Brevio[¦] nerve conduction testing system.
