EMERGENCY RULES
Effective Date of Rule: January 1, 2008.
Purpose: The purpose of this rule is to provide county assessors with the rate of interest and property tax component used in valuing farm and agricultural land classified under chapter 84.34 RCW, the open space program. The rule is being amended to update the interest rate and property tax component used to value farm and agricultural land classified under chapter 84.34 RCW. The amendments provide information that local taxing officials need to value classified farm and agricultural land during assessment year 2008.
The department filed a CR-105 notice of expedited rule making on October 18, 2007, with the intention of adopting a permanent rule after December 24, see WSR 07-21-096. The department still anticipates adopting a permanent rule at that time. The department is adopting this rule, which is the same as that proposed in WSR 07-21-096. Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: RCW 84.34.065 requires the department to annually determine a rate of interest and property tax component. This information is to be set forth in a rule that is to be published in the state register no later than January 1 each year for use in that assessment year.
