PREPROPOSAL STATEMENT OF INQUIRY

     Subject of Possible Rule Making: Commercial fishing and shellfishing rules.

     Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 77.12.047.

     Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Pursuant to SHB 1778, passed in July 2009, the department may create new rules and amend existing rules for commercial fishers and shellfishers, wholesale dealers, retail sellers, and others involved in the commercial fishing and shellfishing industries.

     Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: The Oregon state patrol's fish and wildlife division; the National Marine Fisheries Service; and the Bureau of Indian Affairs.

     Process for Developing New Rule:      Agency study.
