     Effective Date of Rule: September 14, 2010.

     Purpose: Amend personal use fishing rules.

     Citation of Existing Rules Affected by this Order: Amending WAC 232-28-619.

     Statutory Authority for Adoption: RCW 77.12.047 and 77.04.020.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.

     Reasons for this Finding: These lakes are scheduled for rehabilitation using rotenone to eradicate undesirable fish species. Licensed anglers may harvest remaining game fish prior to rehabilitation. There is insufficient time to adopt permanent rules.

NEW SECTION
WAC 232-28-61900E   Freshwater exceptions to statewide rules.   Notwithstanding the provisions of WAC 232-28-619:

     (1) Canal, Heart, June, North-North Windmill, Windmill, and Pit Lakes

     Effective September 14 through October 3, 2010, size and daily limit for game fish: none.

     Effective October 4, 2010, until further notice, closed to fishing.

     (3) North and South Teal Lakes

     Effective September 14 through October 3, 2010, a person may fish in North and South Teal Lakes. Size and daily limits for gamefish: none. Effective October 4, 2010, until further notice, closed to fishing.

     (4) Martha, Lower Caliche, Upper Caliche, and West Caliche Lakes

     Effective September 14 through October 10, 2010, a person may fish in Martha, Lower Caliche, Upper Caliche and West Caliche Lakes. Size and daily limit for gamefish: none. Effective October 11, 2010, until further notice, closed to fishing.
