PREPROPOSAL STATEMENT OF INQUIRY
Subject of Possible Rule Making: Collection agencies, WAC 308-29-025, clarify what records a licensee with no clients must maintain and provide to the department.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 19.16.410.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: ESHB [SHB] 1822 was passed by the 2013 legislature and signed by governor. The bill adds debt purchasers to the definition of what is a collection agency under the Washington Collection Agencies Act. To implement the law change, the department needs to clarify what records will not be required if a licensee has no clients. The collection agency board supports the need for a rule amendment which will be developed during the public participation phase prior to the rules hearing on August 27, 2013. The need for a rule amendment meets the exemption criteria outlined in Executive Order 10-06 and will not impact local government.
