WSR 14-20-116 PREPROPOSAL STATEMENT OF INQUIRY DEPARTMENT OF SOCIAL AND HEALTH SERVICES (Aging and Long-Term Services Administration) [Filed October 1, 2014, 8:27 a.m.]
Subject of Possible Rule Making: Chapter 388-106 WAC, Long-term care services and chapter 388-71 WAC, Home and community services and programs, and other related rules as may be required.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 74.08.090, 74.09.520, 74.36.110, 74.36.130, 74.36.100, ESHB 2746.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: In accordance with ESHB 2746, establish a 1915(k) community first choice option (CFCO) as specified in the federal rule. The DSHS home and community services division will develop a state plan amendment to provide this new state plan option. These rules will define the scope and eligibility of the new 1915(k) services. Other related changes that may arise during this rule making may be incorporated. Other WAC chapters may need to be updated as a result of this rule making.
Process for Developing New Rule: DSHS welcomes the public to take part in developing the rules. Anyone interested should contact the staff person identified below. At a later date, DSHS will file a proposal with the office of the code reviser with a notice of proposed rule making. A copy of the proposal will be sent to everyone on the mailing list and to anyone who requests a copy.
