WSR 16-19-061 PREPROPOSAL STATEMENT OF INQUIRY DEPARTMENT OF SOCIAL AND HEALTH SERVICES (Aging and Long-Term Support Administration) [Filed September 19, 2016, 11:57 a.m.]
Subject of Possible Rule Making: The department is proposing to add to add new sections, repeal existing sections, and amend sections in chapter 388-78A WAC, Assisted living facility licensing rules, related to tuberculosis screening including WAC 388-78A-2480, 388-78A-2481, 388-78A-2482, 388-78A-2483, 388-78A-2484, 388-78A-2485, 388-78A-2486, 388-78A-2487, 388-78A-2488, 388-78A-2489, and other related rules as may be required.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: These rules have not been updated in seven years or more and are unclear, ambiguous, and inaccurate. The rules need to be updated to include the Centers for Disease Control and Prevention recommendations, as well as the department of health regulations. These rule changes will create consistent regulations across the residential care services programs.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: The Washington department of health collaborates and coordinates closely with the department of social and health services (DSHS), residential care services to develop regulations of the requirements associated with tuberculosis in chapter 388-78A WAC, Assisted living facility licensing rules, and other related rules as may be necessary.
Process for Developing New Rule: DSHS welcomes the public to take part in developing the rules. Anyone interested should contact the staff person identified below. At a later date, DSHS will file a proposal with the office of the code reviser with a notice of proposed rule making. A copy of the proposal will be sent to everyone on the mailing list and to anyone who requests a copy.
