PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Chapter 392-380 WAC, Public school pupils—Immunization requirement and life-threatening health condition.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The office of superintendent of public instruction (OSPI) is considering rule making to clarify the procedural and substantive due process requirements governing the exclusion of children from schools pursuant to RCW 28A.210.120
for the 2020-21 school year. Recently adopted rules by the Washington state board of health regarding school immunization requirements increase the possibility that students may be excluded from school due to non-compliance with these requirements.
Process for Developing New Rule: Early solicitation of feedback and recommendations respecting new or amended rules, and consideration of the comments and recommendations in the course of drafting rules.
