Title of Rule and Other Identifying Information: Psychologist and psychology associate fees. The department of health (department) is proposing revisions to WAC 246-924-990 Psychology fees and renewal cycle, to implement recent legislation by: (1) Updating application, renewal, and other fees for a psychologist license; (2) establishing a fee schedule for a licensed psychological associate license; and (3) establishing a fee schedule for participation in the Psychology Interjurisdictional Compact (Psypact).

Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: Establishing these fees helps implement E2SHB 2247 (chapter 371, Laws of 2024), which created the new licensed psychological associate credential, and SHB 1286 (chapter 5, Laws of 2022), which established Washington state's participation in Psypact, an interstate compact for psychologists. While Washington has been participating in the compact since 2022, the department has deferred rule making until collecting several years of data on participation rates.
Additionally, fee schedule updates will support compliance with RCW 43.70.250 and other statutory authority.
Reasons Supporting Proposal: RCW 43.70.250 requires that the costs of each professional licensing program "be fully borne by the members of that profession" through fees. The examining board of psychology's (board) fees were last adjusted by the department in 2019. Since then, program expenses have grown, so that revenue collected through fees is no longer sufficient to administer the program and maintain an appropriate reserve balance. Establishing and amending fees will support the board's ability to protect the public by licensing and regulating psychologists and psychological associates in Washington.
Statutory Authority for Adoption: RCW 18.83.060, 18.83A.130, 43.70.250, and 43.70.280.

Rule is not necessitated by federal law, federal or state court decision.

A school district fiscal impact statement is not required under RCW 28A.305.135.
A cost-benefit analysis is not required under RCW 34.05.328. This rule is exempt from analysis according to RCW 34.05.328 (5)(b)(vi) because it is a rule that sets or adjusts fees pursuant to legislative standards.     
This rule proposal, or portions of the proposal, is exempt from requirements of the Regulatory Fairness Act because the proposal:
Is exempt under RCW 19.85.025(3) as the rules set or adjust fees under the authority of RCW 19.02.075 or that set or adjust fees or rates pursuant to legislative standards, including fees set or adjusted under the authority of RCW 19.80.045.
Explanation of exemptions: The proposed rules adjust fees for licensed psychologists and set fees for psychological associates and interstate compact participation.
Scope of exemption for rule proposal:
Is fully exempt.
