PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Clarifying existing WAC 67-25-183 and 67-25-193, which detail the process of creating a waitlist for services when necessary.
Statutes Authorizing the Agency to Adopt Rules on this Subject: 34 C.F.R. Part 361.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Under the Rehabilitation Act, there are prescribed processes for when resources don't allow an agency to serve all eligible customers. These two sections help clarify that process for the public.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: United States Department of Education, Rehabilitation Services Administration (RSA). The process is coordinated through state plan amendments that are approved by RSA.
Process for Developing New Rule: Based on 34 C.F.R. Part 361.
