BATES TECHNICAL COLLEGE

Subject of Possible Rule Making: Chapter 495A-400 WAC, Student code of conduct.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW
28B.50.140(13).
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: In January 2025, Bates Technical College (college) amended its student conduct code to come into compliance with the Title IX regulations adopted by the United States Department of Education (ED) in 2024. The 2024 Title IX regulations were subsequently vacated by a federal court in 2025. The Title IX regulations currently in effect are those adopted by ED in 2020. The college is updating its student conduct code to bring it into compliance with the 2020 Title IX regulations and their requirements concerning student disciplinary procedures addressing sex discrimination.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: ED. The college is not actively coordinating the proposed rules with ED; however, ED has provided institutions of higher education with guidance on its 2020 Title IX regulations.
Process for Developing New Rule: The proposed rules are based upon ED's 2020 Title IX regulations, and will be presented to the campus community for their feedback on the proposed rules.
