Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: The purpose of this proposal is to set toll rates and policies on the PSG facility, which includes the SR 167 Expressway and SR 509 Expressway. This proposal will also implement toll rates for pay-by-mail transactions on the SR 167 HOT lanes/ETLs. In addition, this proposal will make clarifying amendments to chapter 468-270 WAC, including adjusting the name of the SR 167 HOT lanes to the SR 167 ETLs, in line with how this facility is referenced under chapter
47.56 RCW.
Reasons Supporting Proposal: Per RCW
47.56.895, the PSG facility is designated as an eligible toll facility, and WSTC is required to set a variable schedule of toll rates to maintain travel time, speed, and reliability of the facility. Tolling on the SR 509 Expressway is expected to begin in October 2025, whereas tolling on the SR 167 Expressway is expected to begin in December 2026. This proposal is necessary for WSTC to set toll rates and policies on both facilities before the facilities open to support system performance, program construction funding needs, and ongoing operations and maintenance costs. In addition, this proposal includes a plan for annual toll rate increases of 2.15 percent per year, starting July 1, 2030, subject to review and approval by WSTC, in consideration of anticipated inflation for eligible costs.
As part of the SR 167 corridor improvements project, toll system upgrades are planned to be completed on the SR 167 corridor by December 2025, which will bring photo tolling payment options to the SR 167 ETLs consistent with the existing ETL's on I-405. In support of these upgrades, WSTC must implement toll rates for pay-by-mail transactions on the SR 167 ETLs.
Rule is not necessitated by federal law, federal or state court decision.

NEW SECTION
WAC 468-270-082What are the toll rates on the SR 167 Expressway?
(1) Tables 22 through 36 show the applicable toll rates for the State Route (SR) 167 Expressway by tolling segment, direction of travel, vehicle axles, day and time of travel, and payment method. Tolling segments include:
(a) The SR number 167 roadway between north Meridian Avenue in Puyallup and Interstate 5 (I-5) in Fife. For purposes of this section, this tolling segment is defined as "SR 167 Expressway - East of I-5."
(b) The SR number 509 spur between I-5 in Fife and the SR 509 in Tacoma. For purposes of this section, this tolling segment is defined as "SR 167 Expressway - West of I-5."
(2) One tolling point is located on each of the tolling segments defined in subsection (1) of this section. All customers will be assessed a toll when passing through each tolling point on the SR 167 Expressway, regardless of payment method. In addition, for customers using Pay By Mail, only one Pay By Mail rate differential (defined as the difference between the Pay By Mail rate and the corresponding Good To Go!™ Pass rate) will be applied per continuous trip in a single direction of travel on the SR 167 Expressway, regardless of the number of toll points passed.
(3) Effective July 1, 2030, and every year thereafter, subject to review and potential adjustment by the commission, toll rates shall be increased as described in WAC 468-270-040 (5)(b).
(4) Toll rates shall take effect upon commencement of the tolling program on the facility, as defined in WAC 468-270-080.
