EXPEDITED RULES
DEPARTMENT OF HEALTH
(Board of Optometry)
[Filed July 16, 2025, 11:44 a.m.]
Title of Rule and Other Identifying Information: Optometry examination and licensure requirements; correcting RCW citations in WAC 246-851-490. The board of optometry (board) is proposing amendments to WAC 246-851-490 to correct cross references to subsections in RCW 18.53.010.
Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: In 2024, the board adopted amendments to WAC 246-851-400, 246-851-410, and 246-851-570 through 246-851-600 in response to the statutory changes made by SSB 5389 (chapter 400, Laws of 2023), codified as RCW 18.53.010. The statutory changes inserted two new subsections resulting in the renumbering of the remaining subsections of the law. Three citations in WAC 246-851-490 were affected by the updates to RCW 18.53.010. Because WAC 246-851-490 was open for a different rule-making project at the time, corrections to the citations could not be included as part of the updates to the rule. The purpose of the proposed amendments are to correct the citations to align with the statute now that the original rule project has concluded.
Reasons Supporting Proposal: The proposed amendments ensure the correct subsections of RCW 18.53.010 are cited in rule. By correcting the citations, applicants for an optometry license will be directed to the correct requirements for licensure. The proposed amendments will avoid confusion regarding the requirements for a license to practice optometry.
Statutory Authority for Adoption: RCW 18.54.070.
Statute Being Implemented: RCW 18.53.010 and 18.54.070.
Rule is not necessitated by federal law, federal or state court decision.
Name of Proponent: Department of health, governmental.
