PREPROPOSAL STATEMENT OF INQUIRY
LIQUOR AND CANNABIS
BOARD

Subject of Possible Rule Making: Title 314 WAC. The Washington state liquor and cannabis board (board) is considering repealing, amending, and creating rule sections in chapter 314-55 WAC as necessary to implement ESSB 5403 (chapter 250, Laws of 2025), related to financial interest and management agreements for cannabis retail licensees.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 69.50.325, 69.50.342, and 69.50.345.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Amendments to and repeal of existing rules, as well as the creation of new rules in chapter 314-55 WAC, may be necessary to implement ESSB 5403 related to financial interest and management agreements for cannabis retail licensees.
Process for Developing New Rule: Collaborative rule making. Board staff will hold public stakeholder meetings to discuss rule changes being considered and solicit feedback prior to filing a rule proposal. Interested parties will then have an opportunity to submit written comments on the proposed rules during a subsequent public comment period and may present oral testimony at a public hearing announced with the publication of the rule proposal.
