PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Electrical rules: Electric vehicle supply equipment and competency examinations. Chapter 296-46B WAC, Electrical safety standards, administration, and installation.
Statutes Authorizing the Agency to Adopt Rules on this Subject: SSB 5528, chapter 233, Laws of 2025; and chapter
19.28 RCW, Electricians and electrical installations, including RCW
19.28.031 and
19.28.251.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The purpose of this rule making is to consider amendments to the electrical rules under chapter 296-46B WAC. The changes under consideration would affect requirements for installing electric vehicle supply equipment and electrician and administrator competency examinations.
The amendments are needed to implement SSB 5528 (chapter 233, Laws of 2025), concerning the installation of transportation electrification infrastructure.
The legislation enacted additional certification requirements for electricians installing electric vehicle supply equipment on public works projects that take effect January 1, 2026. Provisions of the bill include:

| • | Persons installing electric vehicle supply equipment on all public works as defined in RCW 39.4.010, must be certified by the electric vehicle infrastructure training program (EVITP) or a similar nationally recognized training program; |
| • | The EVITP or similar nationally recognized program must be open to all general journey level electricians; and |
| • | Certification is required only for work on the electrical components during the installation and maintenance of electric vehicle supply equipment. |
The requirements of the bill do not apply to certain apprentices when the supervising journey level electrician is certified by a training program and for installation projects under contract as of January 1, 2026.
The legislature provided the department of labor and industries (L&I) authority to adopt rules to implement the requirements.
The amendments are also needed to streamline requirements for electrician and administrator competency examinations. The changes under consideration include requiring individuals to use L&I issued unique candidate identification numbers when arranging for administrator competency examinations and increasing the amount of time allowed for testing without having to start a new examination period and retake all sections. The amendments also include updates, clarification, housekeeping, and other changes.
