Title of Rule and Other Identifying Information: WAC 192-01-001 Rule governance statement.
Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: WAC 192-01-001 sets forth the employment security department's (department) rule governance statement. The rule explains what chapters in Title 192 WAC apply to which programs administered by the department. Under ESSB 5525, the department is authorized to adopt rules to administer a new chapter under Title
49 RCW. Currently, WAC 192-01-001 states that the department administers programs under Titles 50, 50A, and portions of 50B RCW. ESSB 5525 created a new chapter in Title
49 RCW and provided authority to the department to adopt rules for the administration of that chapter. Therefore, WAC 192-01-001 should be amended to include Title
49 RCW in the list of titles for which the department creates rules and administers programs. The rule should also be amended to provide the location of the new rules in the department's WAC.
Reasons Supporting Proposal: The goal of the rule making is to add Title
49 RCW to the list of RCW titles that the department creates rules and administers programs for. The rule making will also provide the location of those rules in Title 192 WAC.
Statute Being Implemented: ESSB 5525.
Rule is not necessitated by federal law, federal or state court decision.

This notice meets the following criteria to use the expedited adoption process for these rules:
Adopts or incorporates by reference without material change federal statutes or regulations, Washington state statutes, rules of other Washington state agencies, shoreline master programs other than those programs governing shorelines of statewide significance, or, as referenced by Washington state law, national consensus codes that generally establish industry standards, if the material adopted or incorporated regulates the same subject matter and conduct as the adopting or incorporating rule.
Explanation of the Reason the Agency Believes the Expedited Rule-Making Process is Appropriate: This rule making incorporates, without material change, a reference to the department's new rule making and program administration authority under Title
49 RCW as set forth in ESSB 5525.

The employment security department administers several distinct programs in Titles 50((

RCW, and portions of
Titles 49 and 50B RCW through the Washington Administrative Code. The provisions in chapters 192-04 through ((
192-499))
192-449 WAC apply to the Employment Security Act in Title
50 RCW and other programs administered by the employment security department.
The provisions in chapters 192-450 through 192-499 WAC apply to the Securing Timely Notification and Benefits for Laid-off Employees Act in Title 49 RCW. The provisions in chapters 192-500 through 192-899 WAC apply to the paid family and medical leave program in Title
50A RCW. The provisions in chapters 192-900 through 192-999 WAC apply to portions of the long-term services and supports trust program in Title
50B RCW administered under the employment security department's authority.
