Title of Rule and Other Identifying Information: Chapter 132Z-119 WAC, Supplemental sex discrimination student conduct code and procedures.
Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: The proposed change is to repeal chapter 132Z-119 WAC, which is a now-outdated version of the Title IX supplemental student conduct code. Chapter 132Z-119 WAC is being replaced with chapter 132Z-120 WAC, which complies with the current Title IX regulations. Chapter 132Z-120 WAC was subject to rule making; a rule-making hearing was held on August 5, and the rules were approved by the Cascadia College (Cascadia) board of trustees on September 17, 2025.
Reasons Supporting Proposal: Cascadia completed the process of rule making to adopt chapter 132Z-120 WAC, which complies with the current version of the Title IX regulations and replaces chapter 132Z-119 WAC, which complies with outdated Title IX regulations. Therefore, Cascadia is seeking to repeal chapter 132Z-119 WAC.
Statutory Authority for Adoption: RCW 28B.50.140(13).
Rule is necessary because of federal law and federal court decision, 34 C.F.R. Part 106; Tennessee v. Cardona, 762 F. Supp. 3d 615 (E.D. Ky. 2025), as amended (January 10, 2025).
This notice meets the following criteria to use the expedited repeal process for these rules:
Other rules of the agency or of another agency govern the same activity as the rule, making the rule redundant.
Explanation of the Reason the Agency Believes the Expedited Rule-Making Process is Appropriate: Cascadia completed the rule-making process to adopt chapter 132Z-120 WAC, which complies with the current Title IX regulations, making chapter 132Z-119 WAC redundant.
