Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: Updates the definition of directory information. Information contained in the definition of directory information may be disclosed from a student education record consistent with the Family Education Rights and Privacy Act unless a student opts out of disclosure.
Reasons Supporting Proposal: These changes are being made to update the definition of directory information based on concerns about student privacy, particularly around home addresses.
Statutory Authority for Adoption: RCW 28B.35.120(12).
Rule is necessary because of federal law, 34 C.F.R. Part 99.

A school district fiscal impact statement is not required under RCW 28A.305.135.
A cost-benefit analysis is not required under RCW 34.05.328. Not subject to RCW 34.05.328(5).
This rule proposal, or portions of the proposal, is exempt from requirements of the Regulatory Fairness Act because the proposal:
Is exempt under RCW 19.85.025(3) as the rules relate only to internal governmental operations that are not subject to violation by a nongovernment party; and rule content is explicitly and specifically dictated by statute.
Is exempt under RCW 19.85.025(4).
Explanation of exemptions: These changes impact internal EWU procedures for access to student education records. They do not affect small businesses.
Scope of exemption for rule proposal:

AMENDATORY SECTION(Amending WSR 20-12-061, filed 5/29/20, effective 6/29/20)
WAC 172-191-100Directory information.
Directory information is defined to include: Student's name, ((address,))university email address, telephone number((,)); participation in officially recognized activities and sports((,)); weight, height and ((birth dates of))the month and day of birth for athletic team members; dates of attendance at the university, enrollment status, and class standing; major field of study, degrees and awards received((,)); and the most recent previous educational agency or institution attended by the student.
The university may release "directory information" unless the student ((files a written))submits a formal request restricting the disclosure of the information to the registrar's office. A student's election to opt out of directory information disclosures does not prevent the university from disclosing or requiring a student to disclose ((his/her))their name, identifier, or university email address in a class in which the student is enrolled.
