EMERGENCY RULES

Effective Date of Rule: October 11, 2025.
Purpose: This emergency rule sets commercial chum fishery registrants and rules for Areas 7, 7A, 10, 11, 12, and 12B.
Citation of Rules Affected by this Order: Repealing WAC 220-354-18000N; and amending WAC 220-354-120, 220-354-160, and 220-354-180.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, 77.12.045, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is needed to close commercial chum fisheries in Puget Sound Salmon Management and Catch Reporting Areas 7 and 7A. The United States was informed on October 7 that it is unlikely the one million inside southern chum critical threshold will be met to allow for chum directed fisheries in Areas 7 and 7A. This emergency rule is also needed to set the weekly in-season registration lists for South Puget Sound Salmon Management and Catch Reporting Areas 10, 11, 12, and 12B. There is insufficient time to adopt permanent rules.

(c) Brailing and use of a recovery box is required and must be compliant with WAC 220-354-100 in areas 10, and 11.
(d) Chinook, coho, and sockeye release is required in areas 10, 11, 12, and 12B.
(e) It is unlawful to possess salmon caught in other Marine Areas while participating in this fishery.
(f) Agreement to participate in this fishery requires that a department observer be allowed on board the vessel while fishing if requested by department staff.
(g) Participation requires compliance with WAC 220-354-050 regarding registration and limited participation salmon net fisheries.

Effective October 11 through November 7, 2025, the following provisions of WAC 220-354-160 regarding commercial gillnet open periods for Puget Sound Salmon Management and Catch Reporting Areas 7, 7A, 10, 11, 12, and 12B are as described in this section. All other provisions of WAC 220-354-160 not addressed in this section, or unless otherwise amended by emergency rule, remain in effect:

WAC 220-354-18000PReef net open periods.
Notwithstanding the provisions of WAC 220-354-180, effective October 11 through November 8, 2025, it is unlawful to take, fish for, or possess salmon taken with reef net gear for commercial purposes in Puget Sound Salmon Management and Catch Reporting Areas except as provided in this section, all other permanent rules including release and reporting requirements remain in effect:

(a) Landing and possession limit is 100 marked coho per license for the October 1 - November 8 open period.
(b) All chum must be released.
(c) All retained and released Chinook and coho must be accounted for by marked status in the logbook.
