EMERGENCY RULES

Effective Date of Rule: Immediately upon filing.
Purpose: This emergency rule sets commercial chum fishery registrants and rules for Areas 7, 7A, 10, 11, 12, and 12B.
Citation of Rules Affected by this Order: Repealing WAC 220-354-16000K; and amending WAC 220-354-160.
Under RCW
34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: This emergency rule is needed to clarify release requirements for previously announced gillnet fisheries in Puget Sound. There is insufficient time to adopt permanent rules.

WAC 220-354-16000LPuget Sound salmon—Gillnet—Open periods.
Effective October 14 through November 7, 2025, the following provisions of WAC 220-354-160 regarding commercial gillnet open periods for Puget Sound Salmon Management and Catch Reporting Areas 7, 7A, 10, 11, 12, and 12B are as described in this section. All other provisions of WAC 220-354-160 not addressed in this section, or unless otherwise amended by emergency rule, remain in effect:

(c) In areas 10 and 11 sockeye release is required.
(d) In areas 12 and 12B sockeye release is required.
(e) It is unlawful to possess salmon caught in other Marine Areas while participating in this fishery.
(f) Agreement to participate in this fishery requires that a department observer be allowed on board the vessel while fishing if requested by department staff.
(g) Participation requires compliance with WAC 220-354-050 regarding registration and limited participation salmon net fisheries.

The following section of the Washington Administrative Code is repealed:
