Title of Rule and Other Identifying Information: Chapter 16-752 WAC, Noxious weed seed and plant quarantine.
Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: In response to feedback from stakeholders, the Washington state department of agriculture (WSDA) is proposing to clarify the common names listed for Hedera hibernica in WAC 16-752-610. The common name is currently listed as Atlantic/Boston ivy. WSDA is proposing to remove Boston ivy as a common name and only have Atlantic ivy listed to more accurately reflect the regulated species.
Reasons Supporting Proposal: The correct scientific name for Boston ivy is a common name for Parthenocissus tricuspidata, which is not a regulated article on the noxious weed seed and plant quarantine list. This is confusing to the public and industry, since Boston ivy is listed as a common name for Hedera hibernica. The proposed amendments would clarify the potential for misunderstandings by having the common name accurately reflect the regulated species.
Statutory Authority for Adoption: RCW 17.10.074, 17.24.011, and 17.24.041.
Statute Being Implemented: Chapters 17.10 and 17.24 RCW.
Rule is not necessitated by federal law, federal or state court decision.

Explanation of the Reason the Agency Believes the Expedited Rule-Making Process is Appropriate: The amendment is being proposed to fix a clerical error that will clarify that Boston ivy, Parthenocissus tricuspidata, is not on the noxious weed seed and plant quarantine list.
