EMERGENCY RULES
CASCADIA COLLEGE

Effective Date of Rule: Immediately upon filing.
Purpose: To bring Cascadia College's (Cascadia) student conduct code (chapter 132Z-120 WAC) into compliance with 2020 amendments to the Title IX regulations.

Under RCW
34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest; and that state or federal law or federal rule or a federal deadline for state receipt of federal funds requires immediate adoption of a rule.
Reasons for this Finding: In April 2024, the Department of Education issued a final rule amending the Title IX regulations. Cascadia implemented rules in compliance with the 2024 final rule. In January 2025, a federal court issued a decision vacating the 2024 final rule. As a result, institutions must comply with the 2020 amendments to the Title IX regulations. Cascadia's proposed emergency rules bring its student conduct code into compliance with the 2020 amendments to the Title IX regulations. These rules were reviewed by the board of trustees on March 19, 2025.
Cascadia is now refiling the emergency rules while it completes the process of permanent rule making. Cascadia has filed a CR-101, published in WSR 25-09-066, and a CR-102, published in WSR 25-13-083. A rule-making hearing is scheduled for August 5 at 2:00 p.m., and the board of trustees will vote on these rules at the September 17 regular meeting.
